What is Litigation? Where do I go from here?

Most clients litigate reluctantly because it is expensive, time-consuming and the risk of unfavorable results is a reality. However, for countless legitimate reasons lawsuits may be unavoidable and must be filed and defended by competent lawyers protecting your rights and best interests.

Plaintiff or defendant, individual or corporation, local branch, or national chain, when litigation becomes unavoidable, The Associates is the firm that will have your back. We craft strategies based on realistic assessments of the relative strengths and weaknesses – including collateral issues - of all parties’ positions, and while we litigate aggressively, we also account for possible settlement avenues as well.

Civil Litigation

Civil Litigation

Civil litigation can be considered any legal dispute where two or more parties are seeking monetary damages or a specific performance (meaning, forcing an action) that does not include or extend to criminal law. Rather than a case being a person versus the government acting in is law enforcement capacity as in a criminal matter, civil cases are an individual or business filing or defending a lawsuit against another individual or business.

Commercial Litigation

Commercial Litigation

In Florida, commercial litigation is a form of civil litigation that involves one or more business entities as parties. This involves the process of resolving a dispute related to business or commercial rights and obligations through action in a court of law. This usually includes litigation related to matters including breaches of contract, business torts, and construction claims, but is not limited to just those issues.

Probate & Trust Litigation

Probate & Trust Litigation

Probate litigation involves how assets will be distributed when a person passes away. Probate usually occurs when someone has no will, has a will, or has a trust but failed to funnel all of their assets into that trust, leaving the remaining assets subject to dispute among relatives. If there is no will left in place of the deceased, Florida state law dictates how assets will be distributed. If there is a last will and testament outlining the wishes of the deceased, this will be used to direct estate assets and to whom they will be inherited by – i.e., family members, heirs, beneficiaries, charities, etc. Ideally, these instructions are clear, so that the process proceeds smoothly. However, in some cases, disputes arise that lead to litigation, which is where our firm comes in to ease the process for those in need.
